Potomac Valley Brick and Supply Company reserves the right to publish drawings, written descriptions, photographs of entries and the names of entrants, without compensation.
ENTRANT AGREEMENT
Each participant who submits a design for consideration in the competition shall retain all of his or her rights in the design submitted. For purposes of advancing the success of the competition, however, the participant: (1) authorizes PVB to reproduce and republish the design in both hard copy and electronic media form by such means and with such frequency as PVB shall determine in its sole discretion; and (2) authorizes PVB to affix a copyright notation “© Potomac Valley Brick and Supply Company 2010” on each reproduction and republication by PVB of the design in both hard copy and electronic media form.
PVB will follow any written instructions provided by a participant which are intended to protect the participant’s proprietary interests in his or her design. However, PVB assumes no liability for any losses sustained by a participant resulting from a third party’s unauthorized use of the participant’s design and/or PVB’s failure to implement the participant’s instructions, unless such failure is the result of gross negligence.
Each participant acknowledges that the participant is not a member of the Design Competition Team, nor is he or she an employee of, nor advisor to, PVB, FMG, or a competition juror.
INCOME TAX REPORTING
Prizes and awards are subject to U.S. Income Tax reporting and the Contest winners are required to comply with the following:
U.S. Persons:
Contest winners must complete IRS form W-9 and return to Potomac Valley Brick by February 28, 2011. Prizes will be reported on the year 2011 IRS form 1099 which will be issued in January 2012. Generally, withholding is not required by the IRS, but you are responsible for paying any related federal, state, and local income taxes.
Non U.S. Persons:
Form W-8BEN must be completed and returned to Potomac Valley Brick by February 28, 2011. Prizes will be reported on the year 2011 IRS form 1042-S which will be issued in January 2012. The IRS requires 30% withholding on payment of prizes and you may receive a refund by filing year 2011 IRS form 1040NR. You will need a U.S. individual tax identification number (ITIN) in order to file for a refund and the ITIN can be obtained by filing IRS form W-7. You may want to refer to IRS publication 519 U.S. Tax Guide for Aliens. Please note that although the U.S. may have an Income Tax Treaty with your country, all items of income are not necessarily covered by the Treaty and the Contest prize may still be subject to Income Tax withholding. The IRS also requires your U.S. individual tax identification number to be reported on form W-8BEN in order to claim exemption under an Income Tax Treaty.

CONTESTANT PRIVACY STATEMENT
As a participant in the Competition who submits a design to the Design Competition Team, it will be necessary for you to disclose basic information concerning your identify, including your name, address, company name, if applicable, and such other background information as may appear on the submission forms required to be completed in connection with the Competition. In doing so, you recognize that PVB intends to disclose this information in connection with publicizing the Competition and displaying the designs submitted by the participants. PVB recognizes that you do not intend for the information supplied to be utilized except as may be necessary to meet the requirements of the Competition. Therefore, we hereby confirm that:
- We will not sell, rent or trade any participant information to other companies;
- We will not disclose your information to anyone, except in connection with facilitating the goals of the Competition;
- We will follow any written instructions provided by a participant which are intended to protect or limit the disclosure of the participant’s identity
